A federal judge has ruled the prompt discharge of Kilmar Abrego Garcia from detention by ICE, finding his ongoing detainment is without lawful basis.

"Since his return from wrongful detention in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis stated in her order.

The situation stems from a mistaken deportation to El Salvador in March, which the government later acknowledged was an mistake. Following his return to the United States to answer alien smuggling charges, he was held in immigration custody.

In her order, the court pointed out that the authorities does not have a current deportation order, which prevents them from deporting Mr. Abrego Garcia "at this juncture."
